The website - www.SecureSaadi.Com is a matrimonial service portal and not a dating site. Members must be minimum marriageable age of 18 years (in case of women) or 21 years (in case of men). This platform should not be used to post any obscene material as such actions will be dealt with strictly. SECURESHAADI is intended only to serve as a preliminary medium of contact and information for its users / members / visitors who have a bona fide intention to enter into a matrimonial alliance. SS does not purport to be a marriage or business bureau or a dating /contact website.

In order to use the SecureShaadi.com Site ("Site"), you must register as a member of the Site ("Member"). The Member or any users using the Site agree to be bound by these Terms of Use ("Agreement"). If you wish to become a Member and promote/ advertise your profile to other Members and make use of the SecureShaadi.com service ("Service"), read these Terms of Use and follow the instructions in the Registration process. The Service shall interalia assist you in promoting and making your profile visible to other Members to drive higher Accepts from relevant members. This Agreement sets out the legally binding terms for your use of the Site and membership. This Agreement may be modified by secureshaadi.com from time to time.

SS is an on-line service provider for its members/visitors to create their own/unique profiles envisaging certain personal (optional) information(s) are to be displayed on the net/web-site, which information is used by visitors for searching and matching purposes. SS does not sell, rent, share, trade or give away any of your personal information except which is displayed and intended to be shared by its users / members / visitors including photographs displayed on site. Although SS shall take all reasonable precautions, SS shall not be responsible in case such public information / photograph of the member/user so displayed in the site is being unauthorized copied / printed / published / forged / superimposed / manipulated etc. or misused by any user / member / visitor. The user / member shall indemnify SS from all kind of loss / damages which SS may suffer from any activities carried out by any visitor/user/member through improper use of the service provided by SS.

By listing a matrimonial profile, or a business or personal listing or a link, or any content or listing, on SecureShaadi.com, the person or persons making or posting such listing, and the person or persons responsible for such posting or listing, shall be deemed to have agreed to hold SS harmless and protected against any suit or complaint, civil, pecuniary or criminal, and against any claims or damages (including, without limitation, interests, fines and penalties) which may be brought against or levied on SS on account of any matter arising out of, or relating to, such posting / listing or response received from such posting/listing.

SS does not represent or endorse the accuracy or reliability of any member / visitor profile, advice, opinion, statement or other information displayed / uploaded through the service by SS. SS or any of its owners, staff or agents are not responsible under any circumstances for any action/display whether direct or indirect, which occurs as a result of online display of information in the nature of illicit material / material that may be offensive to visitors / members or is patently offensive to the on-line community or any material which may promote racism, bigotry, hatred or physical/mental harm of any kind to any group or individual or transmit any chain letters or junk mail or unsolicited mass mailing or spamming or obscene material to other users / members. SS does not monitor the conduct of its users/members or visitors and therefore SS does not take the responsibility of any conduct by its users / members or visitors who may avail / obtain / use / exploit the on-line service provided by SS in order to harass, abuse or harm another user/member or visitor or use the said on-line service to promote / advertise / solicit anything without their prior consent or an act in any manner which may threaten the safety of users / members.

SS reserves the right to remove / delete any content / message / photo (s) / profile or cancel the registration / membership of such individual / user either upon a complaint received from another member / user / visitor / individual / group of individuals or upon discovery of the same on its own or based on its sole judgment and perception and it shall without notice stop providing the service entitled to a user / member and forfeit all other incidental service(s) with immediate effect along with the fee/tenure of registration as well as take appropriate legal action against such visitor / user / member. By listing a profile on the website, it is deemed that the said member/user has an intention to get married and in case it appears to SS that at the time of listing the profile or subsequently such user / visitor had no intention to enter into a matrimonial alliance or has changed his/her intention, then SS shall reserve the right to remove / delete such profile from the website and initiate prosecution under the law or take such steps as may be advised from time to time. In using the website, it is deemed that the user/member agree not to post any content or views that may be considered threatening, abusive, vulgar, obscene or otherwise objectionable or act illegally or otherwise harass another user; put wrong or misleading information in any of the details of his/her own profile; impersonate another or use the site for any commercial purposes; or interfere with or disrupt the operation of this site, or disobey any reasonable requirements, procedures or policies imposed by SS from time to time.

SS shall not be held responsible for any interactions/ passing of information(s) etc. between any user / member / visitor via e-mail, chat or any other medium with another member / user / visitor and SS has no obligation, to monitor any such disputes between arising between the users/members and SS shall not be party to such dispute/litigation etc.

SS reserves the absolute right to modify or amend or delete, in any manner as it deems fit, any content of any matrimonial listing placed on SecureShaadi.com in order to ensure compliance with the rules of such placement (which may include, without limitation, the efforts and initiatives by SS to maximize response to matrimonial listings), prima facie accuracy and the prevailing laws in force for the time being, especially those relating to prohibition of any indecent, unlawful or obscene content. SS reserves the absolute right to delete any profile if it finds that the same person has created multiple profiles on the SecureShaadi.com website. Even if different profiles have been created with the same contact details, SS will reserve the absolute right to delete all such profiles. If any member refuses to give consent to physical address verification that SS has requested then SS will have the absolute right to either put a "Not Verified" stamp on the profile or to delete the profile.

Websites to which links are given on SecureShaadi.com and the contents thereof are the sole responsibility of the promoters of such websites and SS does not, in any manner whatsoever, recommend, authenticate, endorse, verify or certify these websites or any contents or links there. SS does not take any responsibility for the privacy practice adopted by such other websites and therefore SS recommends its visitors / users to read the privacy statement of each and every website that the user visits. SS also does not take any responsibility or endorse the authenticity of the other online services linked with SS which may offer various services like a lucky draw, win a free trip, win free tickets, astrology, palmistry, numerology etc. The user / member / visitor of SS shall at its sole risk and responsibility click and surf on to such other website(s) / links which is/are being displayed in the website of SecureShaadi.com. The user shall always bear in mind that at a single stroke/click of the mouse on such links/website, it gets connected through the Transmission Control Protocol (TCP) / Internet Protocol (IP) network of the said users and not through the IP of SecureShaadi.com. SS also does not suggest/encourage any of its users/members to furnish personal information and specially the Profile ID / User Name of SS to such or any other website(s).

SS reserves the right to tie up with partners in future to come up with various other online services. However, SS shall never share the information / data collected from its visitors / users with such other partners without taking prior consent / permission from such visitors / users. SS in such circumstances suggests that its visitors / users peruse the privacy policy of such partners before giving their consent or before furnishing personal identifiable information with such other website(s). SS is not privy to the privacy practice adopted by its partners and does not take the responsibility in respect of the privacy policy adopted / to be adopted by such partners. SS also reserves the right to use / share the information / data collected from its users with its partners if a user / visitor has already made public the information / data to SecureShaadi.com visitors.

SS collects information / data including e-mail id, mail address, first name, last name, telephone number, date of birth, age, gender, ethnic background, appearance, religion, occupation, preferences, life style information, general geographical location from its visitors / users in order to create their unique profiles. Apart from this, certain other information including physical and mental disabilities are also collected. The said information / data collected is entered in the programme especially devised for matching profiles and which programme enable to provide matches for the visitors / users based on their pre-selected criteria. Certain private information is only displayed after taking prior consent of the visitors / users. SecureShaadi.com does not collect financial information such as credit card/debit card numbers/bank accounts numbers etc.

If SS has reason to believe that the proof provided by you is suspicious, then SS reserves the right to remove the authentication seal or suspend, remove, delete the profile at its own discretion.

Your "Name" will be visible to other members who are secureshaadi Paid subscribers either if they "View Your Contact Details" or if you have sent them an Acceptance. Information filled by a member is visible on the profile page. This page is indexed by Google/Ask/Bing/Yahoo and other search engines. If a search engine user types a query then your profile page may be visible in Google/Bing/Yahoo etc. search results. All details which you have put will be visible unless the same has been explicitly hidden by you using appropriate Secureshaadi.com profile privacy settings.

Use of certain features on the website is governed by rules. For example if your phone number is not verified then you cannot contact other members via "Express/Send Interest" or even if the same is happening then that privilege can be blocked by IEIL at any time without giving any notice. Similarly If your phone number is not verified then even as a person who has availed a "Paid Service" you will still not be able to view phone/email/contact details of other members via any option on the website. For verifying your phone number, there are verification prompts across the website which guide you on how to Verify your phone. If the same is not clear then it is the member's responsibility to call customer care of SecureShaadi.com from the number which he/she wishes to verify.

The Grievance officer shall be available between 11 am till 6 pm Indian Standard Time from Monday to Saturday excluding Sunday and public holidays in India. The Grievance officer is appointed as per Rule 3 (11) of The Information Technology (Intermediaries Guidelines) Rules, 2011. Please see in other sections within this user agreement for comprehensive list of offences that Grievance Officer will handle.

22. Proprietary Rights in the Content on SecureShaadi.com.

SecureShaadi.com owns and retains all proprietary rights in the SecureShaadi.com Site and the SecureShaadi.com Service. The Site contains the copyrighted material, trademarks, and other proprietary information of SecureShaadi.com, and its licensors. Except for that information which is in the public domain such as member profile or for which permission has been obtained from the user, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by SecureShaadi.com without refund of any of your unused Subscription fees. We also reserve our right to take legal action (civil and/or criminal) wherever applicable for any violations.

23. Content Posted on the Site.

A) You understand and agree that SecureShaadi.com may delete any listing, content, communication, photos or profiles (collectively, "Content") that in the sole judgment of SecureShaadi.com violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either SecureShaadi.com and/or its Members.

B) With respect to Content you submit or make available for inclusion on publicly accessible areas of the Site including but not limited to your contact details, you hereby unconditionally and irrevocably grant to SecureShaadi.com the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Site and to SecureShaadi Centre members from time to time.

C) You shall use the Services only to market and promote your profile and to reach out to other Members for the purpose of driving an Accept from relevant matches. You understand and hereby agree that all information, data, text, photographs, graphics, communications, tags, or other Content whether publicly posted or privately transmitted or otherwise made available to SecureShaadi.com or SecureShaadi Centre members, are the sole responsibility of the person from whom such Content originated and shall be at the member's/person's sole risks and consequences. This means that you (and not SecureShaadi.com) are solely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. SecureShaadi.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will SecureShaadi.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. SecureShaadi.com reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, SecureShaadi.com may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence, SecureShaadi.com may, in its sole discretion, terminate your Membership without a refund.

D) By posting Content/ advertising to any public area of SecureShaadi.com, you automatically grant, and you represent and warrant that you have the right to grant, to SecureShaadi.com, and other SecureShaadi.com Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

E) The following is an indicative list of the kind of Content that is illegal or prohibited on the Site. SecureShaadi.com will investigate and take appropriate legal action in its sole discretion against anyone who violates this Agreement, including without limitation, removing the offending communication / Content from the Service and terminating the Membership of such violators without a refund.

24. Illegal and prohibitive Content includes Content which

A) is blatantly offensive to the community, such as Content that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual

B) harasses or advocates harassment of another person

C) involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"

D) promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous

E) promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files

F) contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page)

G) displays pornographic or sexually explicit material of any kind

H) provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18

I) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses

J) solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and

K) engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

25. Copyright Policy

You cannot post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the SecureShaadi.com service in a way that constitutes copyright infringement, please provide us with the following information:

26. Member Disputes

You are solely responsible for your advertisement/communications with other SecureShaadi.com Members. SecureShaadi.com reserves the right, but has no obligation, to monitor disputes between you and other Members. SecureShaadi.com also reserves the right to take appropriate action against errant members. However, SecureShaadi.com is not obliged to share such action with other members, including complainants. SecureShaadi.com expressly disclaims any responsibility or liability for any transactions or interactions between the members inter-se.

27. Trust Badge

I) We may provide Trust Badge to you (applicable for select locations in India only) which encompasses Identity Badge, Social Badge, Professional Badge and Reference Badge. Details mentioned below need to be provided for obtaining the relevant Badges:

II) If you opt to avail our verification and Trust Badge service offered by us, you agree to provide the copy of documents to prove your name, educational qualification, income, family photo, residence / office address, marital status (if applicable). Offline verification for Trust Badge is only applicable to Identity and Professional Badge. Once verification is rendered satisfactory, the member's respective Badges are activated online. The aim of offline verification is only to check your availability or to check the availability of the applicable documents as provided by the SS member for the relevant Trust Badge. However, SS does not verify the origin, genuineness, legality of the documents or take any responsibility of the same. Based on the data provided during verification, if there is difference in the data provide in your profile, SS reserve the right to suspend the SS ID.

III) If at any time you happen to edit the details which were provided or verified by SS then the trust badge/verification seal will be removed forthwith.

IV) For Social and Reference Badge entire details is provided by the member on their own and the same will be visible to the general public. Whereas SS will maintain confidentiality of all copy of the documents provided by you in respect of Identity / Professional Badge and shall take all possible and /or bonafide steps for maintaining the confidentiality. The same will not be made visible to the others members. However, SS may divulge such information if required by law or to law enforcement agencies or courts without any intimation to you.

V) Issuance of Verified or Trust Badge would depend upon your willingness to provide copy of the documents or references or tagging of social media accounts.

28. Mode of Payment & Refund Policy

A) Payment made by cash / cheque / Net Banking / Debit / Credit Card would be in accordance with the prevailing RBI guidelines. Activation of paid SS service shall be subject to realization of the said payment. In case of dishonor of Cheque/demand draft; you shall be liable to pay applicable bank's cheque/DD bouncing charges. Further SS service to your account will be deactivated / suspended until you settle the value of the payment and applicable bank charges in cash/cheque.

B) SS uses third party payment gateways for collection of credit/debit card or other payment instruments. In case of payment gateway failure the same would be communicated to the SS member by the payment gateway provider. SS shall not be responsible for Extra currency/conversion charges/deductions/error issues from payment gateway. In the case of failed online transactions, which result in no services, SS offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts through the payment gateway.

C) You agree to provide us with your Permanent Account Number / Form 60/61 of the Income Tax Act, 1961 and rules there under in the event you choose any paid package of SS, the value of such paid package being Rs.50,000/- [Rupees fifty thousand Only] and above from SS.

D) Payments for the services offered by SS shall be on a 100% advance basis. The payment for service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Refund if any will be at the sole discretion of SecureShaadi.com and it offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts. SS gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only. SS undertakes no liability for free services. SS reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them.

E) After the expiry of the SS paid package, the SS member's profiles shall remain on SS/ /Website/consortium of portals from SS itself, until the SS member intimate the finalization of his/her marriage/existence of the Website and intimates the website for removal/deletion of once profile

The User is solely and exclusively responsible for maintaining confidentiality of the User password and User identification and all activities and transmission performed by the User through his/her user identification and shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions and SS assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line. SS uses the maximum care as is possible to ensure that all or any data / information does not fall in the wrong hands. (The weak link in credit card transaction is securely storing the data once received; therefore SS does not store or keep credit card/debit card/bank account. For the purposes of ensuring the maximum security for the financial information of a user (such as credit card/debit card/internet banking data) all such online payment transactions are carried out directly on the secured platforms of payment gateways and not on SecureShaadi.com.

29. Breach

You agree that if we receive feedback/ complaints against your profile in relation to the facts that you are seeking physical / financial favors from our other registered members or have provided incorrect information on our website or committed any unlawful/illegal activities through the use of our Website or created a profile on our Website by impersonation/ fake/ bogus/ false/ misrepresentation/ without consent of the person who's profile is being registered or use only part information including using photo of third parties without the permission of such third parties or act with other members/employees in indecent/improper manner, then we/SS in good faith reserve our right to suspend/delete your profile at our sole discretion without any notice to you, we also reserve to stop all SS services to you and take any action. SS reserves the right to forthwith terminate your SS membership, block/delete your profile and forfeit entire amount paid as membership fee; if at any time SS, in its sole discretion, is of the opinion or has any reason to believe that, you have violated these Terms and conditions of use. We also reserve our right to file appropriate police complaint against you, if the breach of these terms and conditions is/are criminal in nature.

30. Restriction / Prohibitions

You hereby expressly agree not to :

1.  Use of the services of this website in a manner contrary to any law which might be applicable at the relevant time

2.  Access data not intended for you or log into server or account that you are not authorized to access;

3.  Attempt to probe, scan or test the vulnerability of a system or network;

4.  Attempt or breach security or authentication measures without proper authorization;

5.  Attempt to interfere with, access by any other user including but not limited to by submitting a virus of any kind or Trojan horse to this website, overloading, Flooding, mail bombing or crashing;

6.  Copy, distribute, download, display, perform, reproduce, modify, edit, alter, enhance, broadcast or tamper with in any way or otherwise use any material contained in this website except as permitted;

7.  Copy and distribute this information on any other server, or modify or re-use information, text, graphics, sound, etc. on this Website to any other system. No reproduction of any part of the Website may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or Website, whether in hard copy or electronic format, including postings to any other Website;

8.  Remove any copyright, trade mark or other intellectual property notices contained in the original material from any material copied or printed off from this website or link to this website, without our express written consent;

9.  Providing deep links into this website without prior permission of SS is prohibited. Extracting data from this website using any automated process such as spiders, crawlers etc. or through any manual process for a purpose which has not been authorized in writing.

10.  Upload, post, email, transmit or otherwise make available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.

11.  Subscribers shall under no circumstance sublicense, assign, or transfer the License, and any attempt at such sublicense, assignment or transfer is void.

31. Elite Matrimony

Elite.secureshaadi.com (ESSC) is personalized match making services of secureshaadi.com, which is valid for a period of the applicable package chosen by you (and visible on this website) from the date of taking the ESSC package (refund policy as detailed in Clause 28). ESSC may at its sole discretion extend the ESSC services beyond Tenure, however if such ESSC services are provided based on additional payment to be made by the registered ESSC members, if any. Membership to Essc is exclusively through invitation. Essc is an endeavor to help you find your dream life partner (prospect) through the process of searching, shortlisting and contacting prospects, during the Tenure. Upon availing our ESSC service a dedicated Relationship Manager ("RM") will be assigned to you during the Tenure of ESSC Service. based on your set partner preference RM shall assist you in processing your request for lawful marriage partner search through the database of members listed on the consortium of portals owned by SECURESHAADI.COM. ESSC Membership is guided by the terms and conditions mentioned herein below. By using or accessing the ESSC Services, you agree to be bound by all the terms and conditions ("Agreement"). We are provinding the match based on your set partner preferance but its doesn't mean that we are assuring you for marriage

32. Indemnity

By using our SS services you agree to defend, indemnify, and hold harmless SS, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person (third person) through improper use of the service provided by SS. This defence and indemnification obligation will survive in perpetuity.

33. Jurisdiction

If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and and submitting to the exclusive Jurisdiction of appropriate court of law in Mumbai, India only.

ACCEPTANCE TO ABIDE BY TERMS AND CONDITIONS
